1. Who can use the service
Tota Fruits & Veg is a business-to-business wholesale platform intended solely for use by organisations operating in the United Kingdom, such as restaurants, cafés, retailers and other trade customers. By creating or using an account you confirm that you are at least 18 years old, that you are acting in a business capacity and not as a consumer.
Account registration is available via our iOS and Android applications and, where offered, via our website. All accounts are subject to our review and approval process, which may include verification checks and credit assessment.
2. Orders
Orders may be placed through our apps or website subject to availability, cut‑off times and delivery routes. Each submitted order is an offer to purchase goods at the prices and quantities shown at the time of submission.
3. Pricing, invoicing and payment
The final price payable is the price shown on the invoice issued after fulfilment, which reflects actual goods and weights delivered. Prices are exclusive of VAT unless stated.
Late Payments: If an invoice is not paid by the due date, we may charge statutory interest and reasonable recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
4. Delivery
We deliver using our own vehicles or trusted carriers to the areas we serve, including Canterbury and surrounding regions. Cut-off times are communicated in-app and on our site; orders received after the cut-off for a given route will normally roll to the next available delivery day.
5. Risk and title
Risk of loss or damage to goods passes to you upon delivery to the delivery address or safe location agreed. Title to goods remains with Tota Fruits & Veg until we receive full and cleared payment.
6. Quality, inspection, returns and refunds
You should inspect deliveries upon receipt and notify us promptly of any issues. Where a legitimate quality issue is reported within a reasonable period (normally within 24 hours), we will at our discretion arrange a replacement, credit or refund.
9. Warranties and liability
To the maximum extent permitted by law, the service is provided on an “as is” basis. Our aggregate liability is limited to the total amount paid by you to us for goods in the twelve (12) months preceding the event giving rise to the claim.
12. Law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms.
